This Agreement is incorporated by reference to our and any policies pertinent to your use of the Service.

All former or contemporaneous discussions and proposals, whether oral or written, between the parties regarding the such subject are superseded by this Agreement.

By using the Service, you thus affirm and guarantee that:

You meet the legal age requirement and are qualified to join the Agreement in your local jurisdiction;

There are no limitations on your ability to use the Service in accordance with your local laws;
you abide by these Terms and any governing rules and laws;
Only those devices whose owners you are or who have given you permission to install the IG Magnify Software;
Your target device complies with its requirements and you have read the Compatibility Policy.

These Terms are subject to modification at any moment, unless otherwise stated. If there are significant changes impacting how you use the Service or your legal rights as a user, we'll let you know before the changes take effect by posting a notice on the Service or sending you an email at the address you gave us. It is your duty to review the Terms on a regular basis for any updates we make. Your continued use of the Service following the implementation of any changes signifies your acceptance of those changes (s).

To the same extent and subject to the same restrictions as other business documents and records, a printed version of these Terms may be used in court or administrative actions based on or connected to the use of the Service.

Account Registration

By supplying your personal information, such as your name and email address, while creating an account ("Account"), you will be able to make use of all the advantages that the IG Magnify Service has to offer. You consent to receive an email with information on your access to the Service's User Space at the address provided. The User Space allows you to modify the Account's password.

Your account cannot be transferred or assigned. You are entirely in charge of protecting the privacy of the login information you use to sign up for the Application and of any actions taken using those credentials.

Please contact us right away at support@igmagnify.com if you know or have any reason to think that someone has accessed your Account without your permission or that your login information has been misplaced, stolen, or otherwise compromised.

You must make sure that how you use the Service and your Account complies with all relevant laws, rules, and regulations.

You can utilize the Account settings and select "Delete your account" to permanently end your Account. The monitoring of all devices on which the Software is installed shall end upon any termination or suspension of the Service, and access to information that you have provided through the Service or that is connected to your Account.

Accounts that IG Magnify has canceled for any reason, including without limitation a violation of these Terms, are ineligible for reactivation.

IG Magnify Service

IG Magnify Service may only be used for the following purposes: parental control of minors; (ii) on a user's own device; and (iii) by a user with the owner's permission. A user can order a variety of Products using the service.

You are aware that installing the software on a device requires physical access to it. You accept and agree that you are the parent of your minor child when you install the software on a device.

Likewise, you agree that some content may be published to your dashboard within 24 hours of being posted on the target website, and you confirm your comprehension of this.

Furthermore, you acknowledge that installing the Software on a target device by yourself does not in any way put IG Magnify under any sort of liability or responsibility. IG Magnify is not liable for how a user uses the software application because it is not in charge of it, is not being watched, and/or is unaware of it. The user assumes all risk and liability.

Device compatibility with the target. You are aware that you must first confirm your target device's compatibility requirements before ordering a subscription or installing the software. You acknowledge that it is your duty to follow the Compatibility Policy and that you will not be given a refund if you do not do so before the subscription or installation.

Software application license. Only the rules, restrictions, and documentation outlined in the End User License Agreement and by IG Magnify may be used in conjunction with the Software. You acknowledge that IG Magnify may, at any time and for any reason, suspend or terminate any license granted thereunder and disable the Software and any information you may have already accessed or installed. This power is exercised at IG Magnify’s exclusive discretion.

IG Magnify maintains the right, at any time, and at its sole discretion, to add or delete features or functions from the Software.

Updates to services: IG Magnify may occasionally update the Software in an effort to enhance the Service. You understand and agree that IG Magnify is free to upgrade the software at any time, with or without prior notice.

You understand and agree that IG Magnify may ask you to update the software on a target device via email or user space. If an operating system update caused your device to get unlinked from the software, contact customer care at support@igmagnify.com to request a relink.

IG Magnify keeps a database of user login information. The password of the user is not kept. We just keep the blowfish algorithm-generated hash of the password.

When an account is active for more than 3 (three) months, IG Magnify does not save all logs and data that are downloaded from a target device using the software in its database. All data is destroyed once this time period has passed. All logs and data downloaded using the Software from a target device in the case of expired accounts are erased after 1 (one) month.

Data protection: Your personal information's security and integrity are important to IG Magnify Your personal information is encrypted by IG Magnify before being stored in its database, which prevents IG Magnify from having direct access to that data. However, IG Magnify disclaims all liability for any memory leaks in databases or DSN servers caused by third parties. IG Magnify might not be liable if such encrypted data were to be leaked.

Subscription Description

You might have many subscriptions listed under your account. You must place the order in order to subscribe to the Service.

Subscription Plans: The packages for the service vary depending on your device, the number of features you select, and your subscription plan.

You must enter your personal information for the Billing Information and the Payment Method during the order placement process. You acknowledge that IG Magnify does not collect your payment information when you purchase Software; instead, the third-party Payment Provider is the one who receives your payment information.

Subscription Plans: You can select a subscription plan for durations of 3, 1, 3, or 12 months. There are 28 days in a month, which only pertains to the 1-, 3-, and 6-month subscription options. A 12-month subscription is good for a full calendar year (366 days). You are aware that you are only able to use the Software on one target device with a subscription plan.

If auto-renew is not disabled at least 24 hours before the current subscription plan expires, the subscription will renew on its own. In your User Space or account, you can turn off auto-renewal while the subscription is active.

Your login information (login and password) will be emailed to your email when you purchase the software, so you can access your Account/User Space.

Payment information: We help you make payments through PayPal, a third-party payment processor. You agree that the PayPal Terms of Service, Privacy Policy, and other policies will apply to you as soon as you click the link to pay for the Subscription Plan. IG Magnify is under no circumstances liable or responsible for any personal information handled by PayPal.

Please be aware that your bank will use the exchange rate in effect on the date of purchase if your local currency differs from the currency in which the prices are quoted. This is outside our control.

As part of the transaction, a service fee in the amount of $4.99 USD or $4.99 EUR will be charged.

IG Magnify maintains the right to alter Subscription plan costs at any time, provided that users are given reasonable notice of such changes in fees prior to them taking effect. Your consent to pay the revised prices will be confirmed if you continue to use the Service after the effective date of the modification.

Cashback and returns: Please look over our refund policy. You get a money-back guarantee with IG Magnify Software if you're not happy with it for any reason. Depending on the Product package, subscription plan, time since the transaction, etc., you may or may not be eligible for a refund.

Links to third-party websites and services

Some parts of the Service might be linked to or made accessible through material and services provided by third parties, over which IG Magnify has no control. Some other websites that are regulated by third parties may be linked to or framed by the Service. For your convenience and to give you another way to access the information there, these links are provided.

We have not necessarily gone over all the information on those other websites, and we are not liable for any products or services that could be offered through those or any other websites, or for the content of any other website. The inclusion of links to other websites should not be interpreted as endorsing their content. Users do so at their own risk while using any third-party content provided therein. Any losses, harms, or other liabilities resulting from your use of any linked website are not our responsibility.

IG Magnify is the owner and operator of the Service. Unless otherwise specified in writing, all materials in the Service, including text, graphics, information, images, designs, icons, photographs, video, sounds, music, computer code, and any other materials (collectively, the "Content"), are owned by IG Magnify or included in the Service with the consent of the applicable owner and are protected by copyright and other local, national, and international laws.

Without the prior written consent of IG Magnify or the relevant trademark holder, certain trademarks, trade names, and logos used or displayed on the Service are registered and unregistered trademarks and trade names of IG Magnify and/or of relevant holders and may not be copied, or imitated, or used, in whole or in part (s). No right, title, or interest in any downloaded or copied Content is transferred to you as a result of any such downloading or copying, even if you download or copy the Content and other downloadable materials displayed in the Service. You acknowledge that any ownership notices on files you download or print from the Service should not be altered or removed.

IG Magnify hereby grants you a limited, personal, non-exclusive, non-sublicensable, revocable, non-transferable, worldwide license to use the Service on your personal device(s) in the manner permitted by these Terms; and (ii) access and view any Content made available in or through the Service and accessible to you. This license is subject to your compliance with these Terms and the provisions.

You may not incorporate any intellectual property belonging to IG Magnify, the Service users, or any of their licensors into another website or other service without the prior written consent of IG Magnify. You may not also frame any of the Content or give the impression that a third-party website or service is presenting or endorsing it.

IG Magnify retains the right, at any time and for any reason without prior notice, to modify or terminate this license or your access to the Content. The fact that IG Magnify has granted you this restricted use in no way nullifies IG Magnify's ownership of the Content. You should also be aware that we are determined to exercise all legal means, including civil and criminal remedies, to protect our intellectual property rights.

Disclaimer of Warranties

Without explicit or implied warranties of any kind, including without limitation those of merchantability, fitness for a particular purpose, title, non-infringement, and those resulting from the course of dealing or usage of commerce, the Service is given to you on an "as is" and "as available" basis.

Regarding the functionality of the Service or the accuracy, reliability, or completeness of any Content made available through it, IG Magnify offers no guarantees. Before depending on any information, it is your responsibility to confirm it. The Service is used entirely at your own risk. IG Magnify does not guarantee that the Service will be available to you at all times or in all places, that the service at the times or places of your choice; that the Service will be error-free or uninterrupted; that bugs will be fixed; or that the Service is free of viruses or other harmful elements.

The preceding disclaimer might not apply to you, since certain states or jurisdictions do not permit the disclaimer of implied guarantees.

Limitation of Liability

To the fullest extent permitted by law, IG Magnify, its affiliates, licensors, and business partners (collectively, the "related parties") disclaim all responsibility for any losses, including without limitation direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with access to or use of the Service, even if IG Magnify and its affiliates have been advised of the possibility of such damages.

You acknowledge that installing the Software on a target device by yourself does not in any way put IG Magnify under any sort of liability or responsibility. IG Magnify is unaware of the reason a user exploits the software application, does not regulate it, and does not monitor it. The liability of IG Magnify and its affiliates shall be restricted to the greatest extent permitted by law in those states or countries that do not allow the exclusion or limitation of liability for consequential or incidental damages. For any such restrictions, please consult your local laws.

If we are found to be liable to you in any way or if any portion of the warranty disclaimers or liability restrictions are found to be invalid or unenforceable for any reason, then our total liability for all claims arising from such liabilities shall not exceed the entire amount that you paid to us.

Indemnification

The liability of IG Magnify and its affiliates shall be restricted to the greatest extent permitted by law in those states or countries that do not allow the exclusion or limitation of liability for consequential or incidental damages. For any such restrictions, please consult your local laws.

If we are found to be liable to you in any way or if any portion of the warranty disclaimers or liability restrictions is found to be invalid or unenforceable for any reason, then our total liability for all claims arising from such liabilities shall not exceed the entire amount that you paid to us.

Applicable law and jurisdictions

The laws of the United Kingdom, excluding its provisions on conflicts of laws, shall exclusively control and be construed in line with these Terms unless otherwise specified in these Terms or other policies.

Your rights under the laws of your state or nation are not restricted by these Terms. The Service is not intended for you, and we kindly ask that you refrain from using it if any content or feature of the Service, or how you use the Service, violates the local laws where you are when you access it. It is your responsibility to familiarize yourself with and abide by the laws that apply to you.

You agree that any dispute, conflict, claim, or controversy arising out of or generally connected with or relating to the Service or these Terms, including, without limitation, those relating to their validity, construction, or enforceability (any "Dispute"), shall be settled amicably through direct negotiations with the IG Magnify team unless prohibited by applicable law and without limiting any statutory rights for consumers. If an agreement cannot be reached through discussions, the dispute shall be resolved only by the state courts of the United Kingdom, according to its jurisdictional rules, and under the United Kingdom's substantive law.

All claims must be filed within one (1) year of the claim's occurrence unless a longer time frame is mandated by the relevant statute.

By using the Service, you acknowledge and accept that IG Magnify may send you communications and data via email or the Service, including but not limited to I notice about the Service and Products you use or request; (ii) notifications about changes to your Account; and (iii) updates and information or materials regarding transactions in which you are involved through the use of the Service.

You acknowledge that we may contact you using the information you have provided to send you newsletters, marketing or promotional materials, or other information about the Service. By following the instructions in those emails, we'll give you the chance to stop getting these promotional emails from us (s).

Term and Termination

Termination by IG Magnify. We reserve the right to change, suspend, or terminate the Service, content, feature, or offers made through the Service at any time, with or without prior notice, and/or to extend or terminate opportunities to some or all Service users. You acknowledge that, should any of the aforementioned situations involving the Service arises, we won't be liable to you or any third parties.

In reaction to real or alleged violations of these Terms, IG Magnify has the right to take whatever legal measures it may consider necessary, including, without limitation, the suspension or termination of your access and/or account.

Termination by you. By deleting your Account as described in this section "" and ceasing to access or use the Service, you may end this agreement with IG Magnify at any time.

All permissions granted by these Terms will end immediately if you close your Account. Without incurring any duty or obligation to you, we shall remove all information connected to your Account and activity from our servers.

Other Terms

Assignment. At any time, with or without your permission, IG Magnify may assign these Terms in whole or in part to any person or organization. Without IG Magnify's prior written approval, you are not permitted to assign the Terms, and any attempted assignment by you that is not approved will be void.

Severability. In the event that any element of these Terms is found to be defective or unenforceable, the remaining portions shall continue in full force and effect.
